array(20) { [0]=> object(WP_Post)#2794 (24) { ["ID"]=> int(2591) ["post_author"]=> string(1) "6" ["post_date"]=> string(19) "2023-04-28 09:29:30" ["post_date_gmt"]=> string(19) "2023-04-28 09:29:30" ["post_content"]=> string(20307) "Lustration is a loss in civil rights of persons holding state and municipal positions, senior positions in state corporations and other state institutions, organizations, deputies of the State Duma and members of the Federation Council of the Federal Assembly of the Russian Federation, deputies of the legislative authorities of the constituent entities of the Russian Federation, and other persons who have violated: - The Constitution of the Russian Federation, adopted in the 1993 edition; — European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR); — PACE Resolution of 1996 (No. 1481 of 2006 (originally No. 1096 of 1996) “On Measures to Eliminate the Legacy of the Former Communist Totalitarian Systems”; — Universal Declaration of Human Rights, guilty of usurping power and violating the civil rights and freedoms of citizens and peoples of Russia, who supported aggressive wars against other countries and did not exercise active repentance on the date of the start of the work of the Lustration Commission, the Congress of People's Deputies adopts this Act in order to restore justice, promote civil reconciliation, revival of respect for the observance of human rights and fundamental freedoms, creation of legal conditions for the transition from an authoritarian regime to a democratic state, restoration of confidence in state institutions of power, in order to eliminate negative consequences in the political and social life of the Russian Republic, and establishes prohibitions for persons subject to lustration for the following activities: — Implementation of elective parliamentary powers at all levels; — Implementation of official and imperious powers in state authorities and local self-government bodies; — Occupation of positions in the management bodies of companies with state participation; – Holding positions in the management bodies of companies that supply goods and services to state and municipal authorities, as well as companies with state participation; – Implementation of teaching activities in educational institutions of secondary and higher education in the field of humanities and social sciences; – Establishment, financing, management of media editorial offices, journalistic activities, placement of publications and public speaking in the media; – Service in the ranks of the armed forces, law enforcement agencies and public and state security agencies, work in the judiciary; — Carrying out activities related to the production, financing and distribution of audiovisual, musical and film products, as well as the holding of entertainment and public events; - other prohibitions provided for by the Constitution of the Russian Republic for persons subject to lustration restrictions. These prohibitions are necessary to prevent legislative consolidation and propaganda of ideas related to the superiority of individual nations and cultures, humiliation of other peoples, violation of the territorial integrity of states and/or their state structure, as well as in order to exclude the restoration of an authoritarian/totalitarian regime in the Russian Republic.

Main part

1. The basis for bringing to loss of rights (lustration) is: – development, adoption, public support and implementation of the Federal Constitutional Laws of the Russian Federation, federal laws, Decrees of the President of the Russian Federation, legal acts, resolutions adopted by deputies of the State Duma and members of the Federation Council of the Federal Assembly of the Russian Federation, as well as the adoption and implementation of resolutions, decisions of the Government of the Russian Federation, ministries, services, departments, laws and other regulatory legal acts of the subjects of the federation aimed at usurping state power, inciting ethnic hatred, unleashing aggressive wars, violating the territorial integrity and sovereignty of foreign states, committing war crimes and crimes against humanity. These documents include: - Law of the Russian Federation on the amendment to the Constitution of the Russian Federation of March 14, 2020 No. 1-FKZ "On improving the regulation of certain issues of the organization and functioning of public authorities." — Federal Constitutional Law of March 21, 2014 No. 6 (as amended on July 14, 2022) “On the admission of the Republic of Crimea to the Russian Federation and the formation of new subjects within the Russian Federation — the Republic of Crimea and the federal city of Sevastopol.” - Federal Constitutional Law No. 5-FKZ dated 04.10.2022 "On the admission of the Donetsk People's Republic to the Russian Federation and the formation of a new subject - the Donetsk People's Republic" within the Russian Federation. — Federal Constitutional Law No. 6-FKZ dated 04.10.2022 “On the admission of the Lugansk People’s Republic to the Russian Federation and the formation of a new subject within the Russian Federation – the Lugansk People’s Republic”. — Federal Constitutional Law No. 7-FKZ dated 04.10.2022 “On the admission of the Zaporozhye region to the Russian Federation and the formation of a new entity within the Russian Federation — the Zaporozhye region”. — Federal Constitutional Law of October 4, 2022 No. 8-FKZ “On the admission of the Kherson region to the Russian Federation and the formation of a new subject within the Russian Federation - the Kherson region”. — Decree of the Federation Council of the Federal Assembly of February 22, 2022 No. 35-SF “On the use of the Armed Forces of the Russian Federation outside the territory of the Russian Federation”. - Federal Law of July 14, 2022 No. 255-FZ "On control over the activities of persons under foreign influence." — Federal Law No. 32-FZ of March 4, 2022 “On Amendments to the Criminal Code of the Russian Federation and Articles 31 and 151 of the Code of Criminal Procedure of the Russian Federation” (Articles 207.3, 280.3, 284.2 of the Criminal Code of the Russian Federation were introduced). — Federal Law No. 31-FZ of March 4, 2022 (as amended on July 14, 2022) “On Amendments to the Code of Administrative Offenses of the Russian Federation” (which introduced Articles 20.3.3 and 20.3.4). — Federal Law No. 272-FZ of December 28, 2012 “On Measures to Influence Persons Involved in Violations of Fundamental Human Rights and Freedoms, Rights and Freedoms of Citizens of the Russian Federation”. — Federal Law No. 25.07.2002. Categories of persons subject to mandatory lustration 1) Persons who took part in the development, approval, public support and enforcement of the above federal laws, federal constitutional laws, Decrees of the President of the Russian Federation, other regulatory legal acts aimed at inciting national hatred, aggression, suppressing constitutional human rights and freedoms in Russia, to annex the territories of sovereign states, to include the Republic of Crimea and the city of Sevastopol into the Russian Federation, to conduct a special operation in Ukraine, to recognize the independence of the DPR, LPR, the adoption and implementation of four Federal Constitutional Laws of October 05, 2022 "On the entry of the Donetsk People's Republic, Lugansk People's Republic, Zaporozhye, Kherson regions to the Russian Federation; 2) Judges, prosecutors, investigators who made decisions on bringing to administrative and / or criminal liability persons for expressing an anti-war position and / or condemning and criticizing the actions of the armed forces of the Russian Federation provided for in articles: - 128.1, 148, 207.3, 212, 212.1, 274.1, 275.1, 280, 280.1 - 280.4, 282, 282.1 - 282.4, 284.1, 284.2, 330.1, 330.2, parts 2.1, 2.2 of Art. 332, part 3 of Art. 333, part 3 of Art. 334, parts 2.1, 3.1, 5 Art. 337, part 3 of Art. 338, part 3 of Art. 339, parts 4, 5 of Art. 340, in parts 4.5 Art. 341, parts 4, 5 of Art. 342, part 3 of Art. 344, part 3 of Art. 346, Art. 347 (as amended by Federal Law No. 365-FZ of September 24, 22), art. 348 (as amended by Federal Law No. 365-FZ of September 24, 22), 352.1 of the Criminal Code of the Russian Federation. - 13.41, 13.42, 13.46, 13.48, 19.7.5-2, 19.7.5-4, 19.7.10.1 - 19.7.10.3, 19.25, 20.2, 20.2.2, 20.2.3, 20.3, 20.3.1 - 20.3.4 , 20.28, 20.29, 20.33 of the Code of Administrative Offenses of the Russian Federation, - employees of the operational units of the bodies of the Ministry of Internal Affairs of the Russian Federation, the Federal Security Service of the Russian Federation, the Federal Security Service of the Russian Federation, the Federal Penitentiary Service of the Russian Federation, who carried out operational-search activities in cases of this category and the freelancers involved by them; 3) proxies and persons who conducted election campaigning in the election campaigns of the President of the Russian Federation V.V. Putin. between 2012 and 2023; 4) Persons responsible for editorial and information policy, heads of newspapers, magazines, television programs, Internet media, television programs, radio programs, TV and radio program hosts who supported and approved the actions of the President of the Russian Federation, the Government of the Russian Federation on the annexation of the territory of Ukraine, on partial mobilization , to amend the Constitution of the Russian Federation; 5) Citizens of the Russian Federation who propagandized a special military operation in Ukraine; 6) Citizens of the Russian Federation who fell under international sanctions in the period from 2012 until the entry into force of this Act. Citizens of the Russian Federation who were under sanctions, from which the sanctions were lifted by at least one of the following countries: Ukraine, USA, Great Britain, are excluded from the list of persons subject to lustration; 7) Heads, deputy heads, employees of state authorities, who held the highest and main positions in the period from 07.05.2012. according to the List (Appendix No. 1); 8) Other persons who are not included in the above categories and are (equated) to the heads, deputy heads, employees who hold the highest and main positions in public authorities. 3. The term for involving persons in verification and loss of rights (lustration) Within ten years from the date of entry into force of this Act, the persons listed in Article 2 of paragraphs 1 to 8 and who, within three months as of the date of Lustration, have not publicly condemned a special military operation and transferred a significant part of their personal wealth to help political organizations fighting Putin's regime or the Armed Forces of Ukraine or the United24 Foundation or other organizations authorized by the Congress of People's Deputies, cannot carry out the activities listed in the preamble of this Act, and are also deprived of their passive electoral right and cannot be elected to the Parliament of the Russian Republic, legislative bodies of the constituent entities of the Russian Republic, to hold elected positions of state corporations. A ban on occupying leading state, regional, municipal positions in the above authorities can be applied to a person only once. 4. Establishment of a Commission to verify persons subject to lustration 1. The Congress of People's Deputies creates a Commission on Lustration in the amount of twenty-one people with the possibility of subsequent rotation by decision of the Congress of People's Deputies. 2. The Lustration Commission operates during a transitional period, until a new parliament is elected and the Government of Russia is formed. 3. Information about the formation of the Commission is published in the mass media, in the press, on the Internet, on the official website of the Lustration Commission. 4. The Lustration Commission in its activities is guided by the Regulations developed and approved by the Congress of People's Deputies. 5. For the purpose of direct execution of this Lustration Act and maintenance of the work of the Lustration Commission, an Apparatus is created, the staffing of which is approved by the Commission. The Office of the Commission operates on the basis of the Regulations on the Office of the Lustration Commission approved by the Commission. 5. General order of work and duties of the Commission 1. The Lustration Commission draws up, publishes and then maintains an official Register, in which citizens are entered in accordance with the paragraph “Categories of persons subject to mandatory lustration.” 2. Citizens, members of the public and the media have the right to apply to the Lustration Commission with an application to conduct an audit of persons in respect of whom there are sufficient grounds for inclusion in the Register. 3. Persons subject to lustration have the right, within one month after the publication of the Register, to apply to the Lustration Commission to provide information about their non-involvement in the violation of the rights and freedoms of citizens, a special military operation, and other acts of international aggression by Russia. 4. The Lustration Commission has the right to request and demand information about income, the availability of property on the right of ownership in the tax, registration authorities in order to establish the reliability of the information provided about the person's non-involvement in the violation of the rights and freedoms of citizens, a special military operation and other acts of international aggression by Russia. 5. The verification period should not exceed 30 days. 6. Information about the audit is public, the results of the audit are reflected in a special Register of persons subject to verification. 7. The Lustration Commission is obliged to approach individually the consideration of applications and submitted materials in relation to persons subject to lustration. 8. Based on the results of the audit, the Lustration Commission shall make one of the following reasoned decisions: - about exclusion from the list; - the need for additional verification; - on the prohibition to engage in the types of activities listed in the preamble of this Act for up to 10 years; - on applying to law enforcement agencies with a statement on checking the actions or inactions of persons who have committed criminal offenses (military, corruption, etc.); - on the Commission's appeal to the courts with an application for deprivation of the right of ownership of property, funds that are not confirmed by the Declaration of Income, in relation to persons who initiated, adopted and enforced anti-constitutional laws; 9. A reasoned decision is made by the Commission by a qualified majority, not less than 2/3 of the votes of the elected members of the Commission and signed by the Chairman and Secretary of the Commission. 10. The person in respect of whom the check has been carried out has the right to challenge the results of the check and the decision of the Commission for Lustration in court within a month after receiving a reasoned decision of the Commission. 11. The register of citizens subject to lustration shall be subject to official publication in the mass media and on the official website of the Congress of People's Deputies. 12. Control over the actions and decisions of the Lustration Commission belongs to the Congress of People's Deputies. 6. Liability for non-compliance or evasion of lustration 1. This Act establishes administrative liability for non-compliance with or evasion of lustration, for which the Code of Administrative Offenses is supplemented by the following article: “ The implementation by a citizen included in the lustration register of activities prohibited by the Lustration Act - entails the imposition of an administrative fine in the amount of up to 50,000 the minimum hourly wage or administrative arrest for up to 30 days. 2. This Act establishes criminal liability for non-compliance or evasion of lustration, for which the Criminal Code is supplemented by the following article: 1) Providing deliberately unreliable information by a citizen to the lustration commission or concealing information that affects the inclusion of a citizen in the lustration register, is punishable by imprisonment for a term of 3 to 5 years, or a fine in the amount of up to 100,000 times the minimum hourly wage, or community service for up to three years. 2) Repeated performance by a citizen included in the lustration register of activities prohibited by the Lustration Act is punishable by imprisonment for a term of 5 to 10 years with confiscation of property. 3) Failure by a citizen or organization to comply with the restrictions imposed on persons included in the lustration register, when entering into labor or economic relations with them, is punishable by a fine in the amount of up to 30,000 minimum hourly wages for citizens and in the amount of 100,000 minimum hourly wages. remuneration for organizations with the inclusion of a citizen and/or official of the organization who violated the Lustration Act in the lustration register. 4) Violation by officials of election commissions and state authorities of the requirements of the Lustration Act during election campaigns and referendums, is punishable by imprisonment for a term of three to five years, with the inclusion of persons who violated the requirement of the Lustration Act in the lustration register. 7. Entry into force of the Lustration Act 1) The act of lustration is subject to official publication in the media and on the official website of the Congress of People's Deputies. 2) The Lustration Act shall enter into force from the moment the Transitional Period Act approved by the Congress of People's Deputies comes into force. Applications: The list of organizations, state authorities, heads, deputy heads, whose employees held the highest and main positions in the period from 07.05.2012. and are subject to mandatory lustration: 1) Administration of the President of the Russian Federation, 2) Administration of the President of the Russian Federation, 3) Central Election Commission; 4) the State Duma, the Federation Council of the Federal Assembly of the Russian Federation, 5) the Offices of the State Duma and the Federation Council of the Federal Assembly of the Russian Federation; 6) Government of the Russian Federation; 7) Ministries, services, agencies and departments that are part of the structure of the executive authorities of the Russian Federation 8) The Central Bank of the Russian Federation 9) Treasury of the Russian Federation 10) FSB, Investigative Committee of the Russian Federation, Prosecutor's Office of the Russian Federation, Main Directorate for Combating Extremism of the Ministry of Internal Affairs of Russia, Main Investigation Directorate of the Ministry of Internal Affairs of the Russian Federation 11) Russian Guard, Federal Penitentiary Service; 12) Legislative authorities of the constituent entities of the Russian Federation that took part in the approval of the above laws, resolutions, decrees of the President of the Russian Federation, heads of apparatus of the legislative authorities of the constituent entities of the Russian Federation; 13) Executive authorities of the constituent entities of the Russian Federation, 14) Election commissions of the authorities of the constituent entities of the Russian Federation; 15) State-owned companies and corporations, companies with state participation, in which the state's share is more than 50%." We hope that the Tribunal will give a worthy and fair assessment of the crimes of Vladimir Putin and other members of the Russian Security Council, so that they answer for all crimes committed against Russian, Ukrainian and other peoples. The creation of this Special Tribunal is the only legitimate way to achieve this. Cały świat jest głęboko poruszony wojną, którą Rosja rozpętała przeciwko Ukrainie. Stało się niewyobrażalne. W XXI wieku, w centrum Europy ponownie giną ludzie, niszczone są miasta, tłumy uchodźców zmuszone są opuszczać swój kraj. Zwykli ludzie na całym świecie są oburzeni zbrodniami, których dopuszcza się Putin. W świetle ostatnich wydarzeń Rosja jest często spisywana na straty jako beznadziejna. Cały naród jest naznaczony jako kraj barbarzyńców, kraj tyranów, kraj terrorystów. I świat odgradza się od tego kraju. Odgradza się, niestety, nie tylko od rządzącego reżimu i jego popleczników. Wszędzie widzimy próby „zniesienia rosyjskiej kultury”. Wielu Rosjan w Europie robi to samo. Niektórzy z nas wstąpili w szeregi armii ukraińskiej by walczyć z najeźdźcami. Przywódcy światowi coraz lepiej rozumieją to, co powtarzaliśmy od zawsze: Putin nie powinien pozostać u władzy. Im dłużej utrzymuje się jego reżim, tym bardziej jest niebezpieczny dla całego świata. Wyzwolenie terytorium Ukrainy nie wystarczy do zapewnienia bezpieczeństwa. Dlatego chcemy wyrazić wdzięczność za wsparcie, jakie nam okazujecie, aby znaleźć nowe metody unieszkodliwiania płynącego z Kremla zagrożenia dla ludzkości. Utworzenie Kongresu Deputowanych Ludowych jest żywym przykładem tego, że zwykli Rosjanie nie tylko istnieją, ale naprawdę pracują w celu stworzenia lepszej i demokratycznej przyszłości Rosji i całego świata. Kongres Deputowanych Ludowych

  Kongres Deputowanych Ludowych – parlament tymczasowy powołany z inicjatywy 59 rosyjskich posłów różnych szczebli – od federalnych po gminne – w celu realizacji uprawnień władzy ustawodawczej po ostatecznym upadku reżimu uzurpującego władzę Władimira Putina. W obecnej sytuacji, gdy niemożliwe jest przeprowadzenie demokratycznych wyborów w Rosji, członkowie Zgromadzenia Federalnego, regionalnych organów ustawodawczych, deputowani gminni oraz wybrani przedstawiciele władzy wykonawczej są jedynymi przedstawicielami społeczeństwa i państwa posiadającymi legitymację demokratyczną uzyskaną od obywateli rosyjskich – swoich wyborców. Niezależnie od okoliczności zewnętrznych, po faktycznym zakazie legalnej działalności politycznej w Federacji Rosyjskiej, są oni obecnie jedynymi legalnymi posiadaczami władzy w Rosji. Przedstawiciele państwowi posiadający takie uzasadnione pełnomocnictwo, powinni dziś wypełnić swój obowiązek przed elektoratem, przed wszystkimi obywatelami Rosji, przed swoim krajem i przyszłymi pokoleniami. Istotą tych zobowiązań jest stworzenie legalnego ośrodka władzy, który w przyszłości zbuduje Rząd Jedności Narodowej i struktury władzy Wolnej Rosji, a te z kolei, zapewnią wszystko, co niezbędne do legalnego i demokratycznego przywrócenia rosyjskiej państwowości. Kongres Deputowanych Ludowych będzie pełnił funkcje parlamentu Rosji od momentu odsunięcia od władzy reżimu Putina do zakończenia okresu przejściowego, w trakcie którego na nowo ustanowiony będzie system polityczny Rosji i wybrane legalne władze. Następnie Kongres zostanie rozwiązany, a jego postanowienia będą musiały być zatwierdzone przez nowy parlament. W dniach 4-7 listopada 2022 w miejscowości Jabłonna pod Warszawą, odbyło się pierwsze plenarne posiedzenie Kongresu. Przyjęte zostały: Kongres Deputowanych Ludowych zwołał grupę roboczą w celu opracowania koncepcji nowej Konstytucji Rosji. Podczas pierwszego Kongresu przyjęto również decyzję o zawarciu porozumienia o utworzeniu Międzynarodowej Unii Antyautorytarnej, w celu koordynowania walki z reżimami autorytarnymi na całym terytorium postradzieckim. Dodatkowo Kongres zwrócił się do narodów rosyjskich, Ukrainy i świata, a także do parlamentów i rządów państw koalicji antyputinowskiej. Russian forces are preparing for a Ukrainian counteroffensive to seize back the southern city of Kherson, which was captured during the early days of the invasion. In September, Russia illegally annexed Kherson as well as three other regions and subsequently declared martial law in the four provinces. The Kremlin-installed administration in Kherson already has moved tens of thousands of civilians out of the city. Deeming the current Russian government leadership to be illegitimate, the congress brought formerly elected Russian political leaders together to create a neo-shadow government which would lay the groundwork for a legitimate government following Russian President Vladimir Putin’s eventual removal from power. However, this congress was not a civil society conference or roundtable. As American publication The Daily Beast earlier described the event in an article titled “Russian Enemies of Kremlin Meet to Plot Violent ‘Elimination’ of Putin,” the sentiment of those attending was that there is an urgent need to take all measures to physically remove Putin from power, now, and to prepare for the post-Putin era. Among the delegates who spoke to the Kyiv Post was Andrey Sidelnikov. Before being forced to flee Russia due to his activism against Putin, Sidelnikov had been a close confident of famed Russian opposition leaders Boris Berezovsky and of Boris Nemtsov – both of whom are alleged to have died per the orders of Putin. Now heading the international opposition movement Speak up! in London and spending time in Kyiv, Sidelnikov said that it was clear that “the war in Ukraine and the prevention of war in Europe can only happen if we are committed to removing Putin and his regime from power.” This congress was of great importance, stated Sidelnikov, as it was the “First introduction of parliamentariasm into the future government of Russia. How it will finally look in Russia we do not know, but the first step is to create a legitimate authority and democracy. “Secondly, it is important that this democratic movement is founded without political parties and is open to all. The idea is that we lay the foundations of democracy now.” He adds that “the next Congress is being planned and we will consider what will be the laws. I don’t say ‘the new laws of Russia,’ as we do not know what will come of Russia – the geographic country.” The Russian activist highlighted that an important step would be laws regarding “lustration and the removal of people who were supporting the Putin Regime. We need to write new laws for the transformation period which Ukraine must go through. The preperation of free and democratic elections is an important responsibility.” The event, which was strongly pro-Ukrainian, issued a final communique stating that the congress is “ready to coordinate on behalf of Russia to work together to identify and punish those responsible for war crimes in Ukraine, as well as to implement an effective sanctions policy against Russian citizens responsible for unleashing and waging hostilities. We also ask you to inform us of the Russian assets arrested on the territory of your country and the sub-sanctioned Russian citizens in order to unblock them as soon as possible for use in restoring the economy of Ukraine, which suffered from the aggression of Putin’s regime.” Ilya Ponomarev, one of the founders of the congress said that, “People complain that we are rushing – all the contrary: We are too slow. Everyday hundreds are dying in Ukraine. Every day our comrades remain political prisoners in Russian jails. Every day, more who burn for truth, like Nemtsov and Politkovskaya are murdered,” reflecting that the only solution is that, “Putin’s dictatorship must end.” When Ponomarev was asked what the relationship was between his congress and other well-established Russian opposition organizations, such as the Vilnius-based Free Russia Forum of Garry Kasparov, Ponomarev responded that, “We like the Vilnius Forum of Free Russia. They are the largest political discussion platform and I even helped to establish it,” continuing that, “We all still consider all of the people from the Forum to be our friends, despite the fact that most of the Forum’s participants probably tend to disapprove armed resistance to Putin, which I think is a necessity.” Ponomarev explained that the congress in Warsaw is “not competition for the Vilnius forum” as the congress is “not a political organization, nor a forum,” rather it is “a proto-parliament to become the full-fledged one in the moment of change. And it has – as all parliaments do – representatives of different views and approaches. In its first session the congress laid down the rules, at which conditional resistance is legal; and praised everyone who acts within the rules, which the Vilnius forum most certainly does.” An important conclusion of the congress was the formation of an Anti-Authoritarian Union to oppose Putin’s totalitarianism. Among the initial co-signers were representatives of Tajikistan, Chechnya, and Russia. Congress organizers said that Turkmen, Kazakh, and Georgian officials were expected to sign the charter in the near future. Based upon the Kyiv Post’s conversations with Central Asian and Belarussian activists present, countries that had formerly been part of the Soviet Union, now living under Putin-backed dictatorships, realize that now is the time to join forces against the Kremlin’s sponsorship of their local dictators. Dmitry Bolkunets, a Belarussian opposition political expert, told the Kyiv Post that now is the time to unite forces with the democratic oppositions from other post-Soviet countries as, “Right now, the dictators across the former Soviet states are weak. This is true in Belarus, too. Popular sentiment strongly opposes Belarus involvement in the war in Ukraine, and Lukashenko knows that his own people may turn against him. If all of the former republics begin pushing against their Moscow-backed dictators, together, now in unison, we have the real ability to create a democratic shift across the region.” “People increasingly understand that defeating Lukashenko will be a significant step in breaking Putin’s dreams. Fighting Lukashenko is a direct avenue to stopping Putin’s war machine,” continued Bolkunets. The young Belarussian activist contends the democratic nature of the congress was aligned with what many in Belarus’s democratic opposition had been saying; namely that, in the case of Belarus, it is worth testing online elections to create a legitimate representative body. “Elections are an opportunity to consolidate the population and democratic forces. The success of online elections in Belarus will make it possible to develop it on a larger scale at the next presidential election in Russia in March 2024. If the society does not trust state institutions, then the civil society should take responsibility for organizing fair elections in parallel to what the government does.” The date of the next congress has not yet been set, but organizers promised that it would be consistently growing in size as the increasingly clear need of removing Putin from power grows. However, in today’s Russia, someone quietly went to the Bahamas, someone – to the Canary Islands, someone – to Dubai and Switzerland. Few have publicly resigned. Boris Lvin resigned from the post of Deputy Director of the World Bank from Russia. There are people fighting the regime in Russia itself and paying a high price for it. Others are fighting with weapons in their hands as part of Russian volunteers in the Armed Forces of Ukraine. Partisans operate in Russia. Compared to 1939, there are more people who spoke out against the regime in the current war. You were an adviser to Putin. You know the climate at the top of government. Are there people who think differently? The democratic world is different. Poland thinks of one thing, the Hungarians of another, Serbia of a third. I would divide the mood in Europe into three groups. At one pole – Poland and the Baltic countries. On the opposite side, not Hungarians at all, but Serbs. Other countries are located between these poles. As for the end of the war, or rather, wars, Putin’s wars, they will end only with the end of this regime. There are radicals in the Russian opposition who support the physical liquidation of Putin, others talk about the need for an international tribunal. What do you think of it? Putin’s actions are criminal, so a tribunal is needed. Whether it be national or international. It can take place in Bucha, Mariupol, Sevastopol or Moscow. The main thing is that it should be. In hopes of an end to this grim reality, some wait expectantly for Vladimir Putin to leave office. To change the country, however, it is not enough for Mr. Putin to die or step down. Russia’s future leaders must dismantle and transform the structures over which he has presided for more than two decades. The challenge, to say the least, is daunting. But a group of politicians is devising a plan to meet it. Composed of well-known opposition figures as well as younger representatives from local and regional governments, the First Congress of People’s Deputies of Russia met in Poland in early November. The location, Jablonna Palace outside Warsaw, was symbolic: It was the site of early negotiations in the round-table talks that led to the end of Communist rule in Poland. There, over three days of intense debate, participants laid out proposals for rebuilding their country. Taken together, they amount to a serious effort to imagine Russia without Mr. Putin. The first and most pressing priority, of course, is the invasion of Ukraine. Everyone at the congress opposes the war, which they assume will be lost or lead to nuclear disaster. To deal with the consequences and to prevent a repeat tragedy, they propose an “act on peace” that would demobilize the army and end the occupation of Ukrainian territory, including Crimea; create a joint group for the investigation of war crimes; pay reparations for damaged infrastructure and the families of the dead; and reject future “wars of conquest.” In addition to offering a deterrent to future expansionism, this wide-ranging pledge would provide an essential reckoning with Russia’s history of imperialist invasion. The officials responsible for the devastation will need to be rooted out, too — something that never happened after the collapse of the Soviet Union. The congress would bar from working in state and educational institutions those who belonged to “criminal” organizations — such as the Federal Security Services or state television channels — or publicly supported the war, as well as restricting their voting rights. It would also create a “de-Putinization” commission to consider the rehabilitation of certain groups, including those who publicly recant and did not commit especially serious crimes, and open the archives of the security services. Then there’s the structure of Russia itself. The Russian Federation is highly centralized, with a patchwork of over 80 republics and regions that are strongly subordinate to the president, enabling the accumulation of enormous power. The congress, drawing on decentralized visions from around the time of the Soviet collapse, proposes to dissolve the Russian Federation and replace it with a new parliamentary democracy. According to a broadly worded draft provision on “self-determination,” the future Russian state should be “joined on the basis of free choice by the peoples who populate it.” This break with the present could correct the failed promises of the past. From Vladimir Lenin to Boris Yeltsin, modern Russian leaders have a history of offering decentralization to win support and then reneging once they consolidate power. Though all federal subjects are legally equal under Russia’s current Constitution, substantial inequalities persist — a fact that has been highlighted by the disproportionate deployment and death of ethnic minorities from poorer republics like Dagestan and Buryatia in the war in Ukraine. Revisiting the issue of greater sovereignty could allow the breakaway republic of Chechnya, for example, to leave Russia after its brutal subjugation by Mr. Putin, while enabling regions and republics without strong secessionist movements to renegotiate the allocation of resources and balance of power with the center. It would create a fairer country while undermining Russian nationalism. The congress is vaguest on its economic plans. One act promises to “review the results of privatization” carried out during the 1990s (which led to the rise of Russia’s oligarchs), while another aims to cancel Mr. Putin’s highly unpopular pension reform of 2020. Missing, however, is a commitment to a strong social safety net or any discussion of transitioning Russia’s economy away from its dependence on energy exports. This is a major oversight. Since the 1990s, when privatization and free elections were introduced simultaneously, wealth and power have been intertwined. Political and economic reform cannot be viewed in isolation from each other. That’s not the only hitch. The congress’s main organizer and sponsor is Ilya Ponomarev, a leftist tech entrepreneur. The only member of the Russian Parliament to vote against the annexation of Crimea in 2014, he left the country, obtained Ukrainian citizenship and now runs a Russian-language news channel in Kyiv. A controversial figure in opposition circles, in August he endorsed the assassination of Daria Dugina, the daughter of the Eurasianist philosopher Alexander Dugin, and asserted it was the work of a secret partisan army inside Russia. This uncorroborated claim outraged fellow opposition figures. Mr. Ponomarev was subsequently disinvited from an event organized by the longtime Kremlin critics Garry Kasparov and Mikhail Khodorkovsky. Despite their disagreements, Russia’s opposition has a loosely converging vision for the future. Mr. Khodorkovsky and Aleksei Navalny, the country’s most well-known dissident, who is currently languishing in a penal colony, have also issued calls to turn Russia into a parliamentary democracy with more power devolved to the local and regional levels. But associates of Mr. Navalny did not attend the congress, nor did Mr. Kasparov or Mr. Khodorkovsky. Its legitimacy — already challenged by a number of Russian antiwar organizations that said it does not represent them — was also questioned by some participants, several of whom left in protest over what they saw as a lack of equality and transparency in how it was being run. Such feuding doesn’t help the proposals, which can seem far-fetched. Yet history shows that radical developments are often incubated abroad or underground. In the late 19th and early 20th centuries, political émigrés in bickering communities around Europe plotted the downfall of the Russian empire. Among them was Vladimir Lenin, who was living in Poland at the outbreak of World War I. For now, with most of Russia’s population forced into quiescence while others lose their jobs or freedom for expressing dissent, the possibility of the country’s transformation appears remote. Change, however, can come when it’s least expected. In early 1917, a pessimistic Lenin lamented that he probably wouldn’t live to see the revolution; a few weeks later, the czar was overthrown. Russia is no more doomed to repeat the past than any other country. The time to reimagine its future is now. - The Russian Federation is not a free, legal, democratic state.

- Russian statehood is in the deepest crisis, threatening the survival of the peoples living on Russian territory. Putin's criminal actions first led to the appropriation of vast national wealth by a small group of his cronies, and then to aggression against his immediate neighbors. The Kremlin regime threatens its own people and the world with annihilation in a nuclear war that will inevitably become global. - The "nullification" of the Russian Constitution, adopted in a dubious referendum as a result of the bloody events of 1993, combined with increasingly sophisticated techniques of election fraud at all levels, has led to the fact that there are currently no legally elected functioning institutions of power in Russia, from the president to municipal assemblies. - The current situation is in fact a state of emergency, and the norms of federal legislation on the state of emergency apply to it, in particular, Article 14 of the Federal Constitutional Law "On the State of Emergency", according to which the term of parliamentary powers is extended for the duration of the state of emergency that arose in March 2014 after the start of the invasion of Ukraine; - in the context of a comprehensive crisis that has engulfed Russian society and the state, which is exacerbated by the conduct of an aggressive war, we declare the Congress of People's Deputies to be a permanent body of popular representation and legislative power in Russia, whose task is to prepare the legislative framework and, subsequently, to form temporary institutions of executive and judicial power in the transition period.

In assuming these obligations and the rights associated with them, the Congress:

- Declares its commitment to the values of freedom and human rights as defined in the Universal Declaration of Human Rights, adopted by resolution 217 A (III) of the United Nations General Assembly of 10 December 1948, and in the European Convention for the Protection of Human Rights and Fundamental Freedoms (as amended and supplemented on 1 June 2010); - affirms that the sole bearer of sovereignty and source of power in Russia are the peoples of Russia; - declares its adherence to democracy and the republican form of government; - condemns the tyranny that has seized power in Russia; - recognizes as unlawful any decisions by Putin, his government, and his subordinate structures; declares unlawful the execution of such decisions except in cases where non-compliance poses a direct threat to the life and liberty of citizens, or where the execution of such orders is objectively necessary for the public good; - condemns and rejects totalitarianism, autocracy and the imperial nature of government in any form; - сondemns all civilian casualties and rejects terrorist acts against civilians, regardless of worldview; - states the necessity of constitutional reform, since the Constitution adopted in 1993 failed to protect the democratic government from the forces of tyranny; - Acknowledges the necessity of large-scale reforms, which should result in a new Russian state based on democracy and the rule of law; - Recognizes the necessity of participation in the nation-building of all political forces, with the exception of those who openly oppose the provisions of this Declaration, and calls on the Russian opposition of different views to take part in the work of the Congress; - Declares its determination to prevent a revanchist movement of the forces of tyranny, for which purpose all necessary legislative measures will be taken, including lustration measures; - Declares its commitment to freedom of speech, and in this connection considers it necessary to open and publish the archives of the Soviet secret services, the closed archives of the Soviet authorities and the CPSU, as well as those of the secret services of the Russian Federation; - Recognizes and affirms the right of peoples to self-determination as defined by the United Nations Charter and the Declaration on Principles of International Law concerning Friendly Relations and Cooperation among States, adopted by United Nations General Assembly resolution 2625 (XXV) of October 24, 1970, and believes that the future Russian state must be based on the free choice of the peoples populating it, and the form of government must be determined by their authorized and legitimate representatives elected in direct, universal elections - acknowledges as a priority the development of all nations living on the territory of Russia, the legislative provision of conditions for the preservation of their language and culture, including support of educational programmes in their native language. The congress recognizes the legal subjectness of the Russian people and their right to the preservation and development of their own ethnocultural identity, which the state must ensure by law; - Considers it necessary to carry out the complete de-occupation of Crimea and other Ukrainian regions with the withdrawal of all military units, condemns acts of annexation and wars of aggression against other states; - Considers the policy of supporting unrecognized pseudo-state formations throughout the former USSR unacceptable other than through legitimate UN decisions; - Approves the state borders of Russia as of February 19, 2014; - Recognizes the need for fair compensation to the Ukrainian people and the Ukrainian state, the specific forms and amounts of which will be determined by relevant agreements; - Understanding that it is necessary to establish a constitutional ban on a preventive nuclear strike, as well as on any use of the Armed Forces of Russia, except to defend its territory, to fulfill allied obligations within the framework of defensive alliances, or by direct order of the UN Security Council. The multinational people of Russia, which under the Constitution is the only source of power, is deprived of the opportunity to legally change this power. The war of aggression unleashed by Putin's regime against Ukraine is criminal. A number of countries have already recognized Russia as a state of terrorism or an accomplice to terrorism. The Movement of Resistance of the Peoples of Russia is a combination of all political forces and initiatives against tyranny for the restoration and protection of their rights. We urge the building of the movement in accordance with the principles of the rule of law, democracy and federalism, as formulated in the founding declaration of the Congress of People's Deputies. The aim of the Resistance Movement is the transition to a Russian society based on the principles of the rule of law, democracy and federalism and an end to the war of aggression against Ukraine. The Congress of People's Deputies recognizes the right of uprising, resistance to oppression and struggle against usurpers of power as a natural right possessed by the peoples of Russia. The Congress of People's Deputies recognizes the right of the citizens of Russia to any form of resistance against Russian aggression on the territory of Ukraine within the limits stipulated by the norms of international law. Russian citizens fighting in the ranks of the Armed Forces of Ukraine have all the rights of combatants, including when captured. The Congress of People's Deputies expresses its support for all Russians who continue to fight against Putin's tyranny, despite the continuously intensifying police pressure and direct violation of the norms of the current Russian Constitution. The Congress of People's Deputies recognizes all forms of resistance, including peaceful protests, distribution of truthful information, human rights activities, educational work, resistance to arbitrary rule by force, as being in compliance with generally recognized principles of international law. Subject to the following conditions: Resistance participants are guided by the Hague Convention on the Laws and Customs of War on Land of 18 October 1907 and the Geneva Convention of 12 August 1949 on the Protection of Civilian Persons in Time of War; The members of the Resistance do not attack the civilian population and do not deliberately endanger their well-being by their actions. The participants of the Resistance Movement, including political prisoners already imprisoned, are subject to international norms of legal protection. All criminal prosecution limitation periods for crimes committed against resistance participants shall be revoked. We inform you, that we accept authority and functionality of legitimate transitional parliament of Russia which will carry out the functions up to election of new legal authorities until after the transition of power is over.
